Can I sell counterfeit products on eBay?

Dear Salehoo members,

I recently purchased some PS3 controllers from one of the wholesaler in Dhgate...turns out to be fake, eventhough they have good feedbacks and high rank wholesaler... but they all look good quality.

Anyway, if I sell it online via ebay and when ppl start asking questions, if I tell them that they are not original, will I get into trouble? Will ebay banned me?

The quick answer is that you can't legally list them as genuine products to start with, and if they actually carry any licensed branding on them, you can get into serious hot legal water form the trademark owner themselves.

You've fallen into the same trap as so many do, trying to source genuine products from China. Doesn't matter what they tell you or who you buy them from, you will not source genuine branded products from a Chinese supplier.

You're actually lucky that they got through customs without being seized to be honest, they are really hot on fakes at the moment.

Yes! You will get in BIG trouble if you list your counterfeit PS3 controllers on eBay. Counterfeits/ copies/ fakes/ bootlegs are NOT allowed on eBay, please read their policies addressing that:

Also, we have stressed in several posts (on forum) to stay away from any products that are offered as branded by any Chinese supplier as the likelihood of these being fake is 9 out of 10. In fact we had mentioned it in our description for DH Gate as a warning:

Important Note: Please be aware that a lot of sellers use this marketplace to sell counterfeit goods and we do not recommend purchasing ANY branded goods off this site as there is a 99% chance they will be fake.

DH gate is a great source for most items except brand name products.

You can try selling those in other venues will garage sales or flea markets but I doubt you can sell those online and get away with them being fakes.

There are number of legit Chinese suppliers in our directory but you cannot expect to buy authentic brand name products from them. Our Chinese suppliers are great if you are in the market for generic items only.

What products are you interested? We'd be quite glad to help point suitable suppliers.

I am interested in consumer electronics, like mobile phones and digital cameras. I know ChinaVision is also another great supplier, but I prefer not to sell a generic/china made brand because I find them hard to sell.

I am also interested in clothing for baby/maternity/lingeries products.

Hi felfra,

If that is the case then you have to stay away from the Chinese suppliers - Honestly finding a Chinese supplier offering and selling authentic brand name electronics (or any product type for that matter) is like looking for a needle in a haystack. :( If you continue to source branded products from Chinese suppliers you should be aware that you're a playing with fire and you will get burned big time.
