Banggood - dropshipping problem

I had someone buy an expensive $430 upair quadcopter and claim they received a used item. They are currently using the refund process to try and get their money back. I have contacted Banggood numerous times through their email and chat and basically get the same response. They will say in chat 'we got your email', 'salesman be back', 'we hurry up' etc. What happens is that I still have no resolution to my problem. Biggest issue for me is that I have sold many quads so far and have no choice right now except to hope everything else goes ok. It has not by the way already another person has claimed a damaged package and motor on a $135 quad and asked for a return immediately after getting the package.

This scam on ebay... I am seriously considering dedicating my time to informing the 'public' about it. If they do not refund my money I will let as many people know that buyer protection means sellers get stolen from. This bayangtoys quad is just another example... an upgraded board probably costs like $20 or something but its cheaper to buy (I meant steal) from a seller on ebay. Its dead simple...

scammer buys an item

scammer gets the item

scammer complains about damage

scammer waits and replies to seller about damage

ebay decides seller needs to accept the return (by default it seems)

ebay makes seller pay return shipping on "damaged" item

scammer ships "broken item" (or no item at all but there is a shipment)

ebay refunds the scammer with sellers money

seller can report the "crime"

ebay *may* refund if crime report number is given

scammer may have to deny allegations to police

scammer gets away with crime nothing more will be done

if this bayangtoys quad is another scam then its just a variant of the above where a real and even working item is returned but its an older less valuable and used item. I have read from ebay how untrue this is but I have experienced this first hand I know it does! They also stated earlier this year they have imporoved the system... they have no they just increased the amount of time the scam takes by 6 days.

Yes, certainly not a perfect system, but eBay has been slanted toward buyer protection for a long time now.

I'm being scammed and I don't know what I can do about it... I have his trash with torn out wires etc... I basically got his crashed quad that he tried to repair. I wish I could believe ebay will do something about this but confidence is not high. The different ages of the plastic are obvious. This gimble is yellowed and the camera is broken

Does it look anything like the photos sent to you when he first complained?

called ebay they said something about 3rd party shipper and not being willing to do anything about it. They took the money tho... Its got yellowed plastic. I am reporting all this to the IC3 which is basically the FBI for internet fraud

Using ebay is out of the question if this is the outcome I can expect everytime. With what I have done so far with banggood I could have expected to make maybe $40 but as it is now I will loose at least $650 (minimum). I have asked Yumi for a way ebay could contact banggood to verify the order details so when I appeal the decision maybe that will change the outcome.

You have to speak with Yumi about this, see what can be done, if anything. The trouble is, if you have been scammed, then Banggood won't be able to just give you your money back. About the only course of action you really have is cival, but I just can't see that being successful unless banggood can prove that item is not the one they sent by the serial number.

If you can prove that, then eBay may even take another look at the case.

I'm really not trying to get my money back from banggood I want this scammer to be seen as the criminal he is. I am asking questions on lawyers.com about someone who has misused the consumer protection laws. There has to be a solution that does not seem like a bandaid fix or a bigger wound figuratively speaking.

The problem really isn't ebay its the consumer protection laws. From what I just read they really had no choice and have streamlined the process. No matter what return policy you state on ebay or anywhere else its meaningless as soon as the buyer claims the item is not as described. ITS THE LAW! This is basically an honor system for buyers. I keep thinking that it cant be this easy but everything I am reading on the internet suggests that it is.

If you could provide proof that the wrong item was returned to you, then you could have recaourse, but you would need pics from the buyer showing what they received and it those pics would need to be different to what they snet you. So you would need some way to vladidate the authencity of the product.

Chances are they they have gotten away with it. Cival action is going to be very difficult and I doubt there is any case at all at this point. I'm not a lawyer of course, so I may well be completely wrong.

I think you need to epak with Yumi, see what they can help you with in regards to sending you parts to repair, they may be able to give you a good price on replacement parts. I think you just need to get it running, clean it up as much as you can and resell second hand to recoup at least some of your money.

What they show in the pics is a mint condition quad copter not this worn old quad with alot of slightly yellow to very yellow plastic.

Actually just took another look at the pics and that is what they sent me but that can't be what they were sent by banggood =( The pics do not show the yellowing very well

Have you asked Banggood is they keep a record of the serial numbers of items they send for idetification, that would be solid proof if you have one with a different serieal number or any other identtifying feature that log.

I would cahse that up, that's pretrty much the only way you can prove this item isn't the one that was sent to the customer at this point and that may even not be enough now. If eBay didn't require him to provide them with the serial number before shipping, then he will be able to mount the argument that you are just showing you have a different drone, not the one he sent you.

So this may well be a dead end if that is something eBay didn't require. If that is so, then I would be speaking to eBay and asking why they allowed the customer to simply return you a different product to what you sold him by not requiring prrof of what he was sending to you. If that's the case, then there is absolutely nothing stopping anyone from just replaving a new product and sending back a beaten up old one and gettiong a full refund on their purchase.

Surley eBay have to require some evidence that the correct product is being returned and a tracking number certainly doesn't do that.

The BC people are using "certificates" and trackable mail to prevent charge backs. It would be nice to have more control about when/if I need to do something about a buyers claims. If they have bought a "certificate" this all but eliminates the problem of warranty. The fact they also get items is a miracle and separate from the payment... It puts reputation as more important than "trust based" laws that inflate item prices.

Another insult to injury... someone buys a "pocket quad" fq777 and send the messages "I don't like it" and "It's too small" then gives negative feedback saying "Very bad". Ebay only allows me to give a positive feedback!

How do you mean that eBay will allow you to give postive feedback, is that the only option left now as a seller?

Can not leave neutral or negative I only have "Leave Positive Feedback" as an option.

Apparently negative feedback for buyers has not been allowed since 2008,.. its been a long time since I sold on ebay! This is another reason I am finished as a seller on ebay.

banggood warehouse sent pictures of the box an upair quad comes in they are willing to help but without someone listening or asking the right questions nothing can happen =(.
