Back to the email from Yumi... being told they will send a gimble really doesn't help me as the thief getting another item would just be more loot for him. What might help would be knowing that if this goes to court that I can count on banggood typing or writing a letter or something through our court system when or rather if its time stating when the quad was shipped and that they shipped the item to him unused. Not saying that will happen I have no idea what is going to happen but it might.

That said I have not contacted ebay yet I am waiting to see if this person actually sends something to me and I need to see what I get. I am assuming I will be making another phone call to ebay so I will ask them about access to this transaction then. banggood FYI I do think you are harmless in this (IE: you did not send someone junk).

Just a little clarification... I am in the position of needing to proove that banggood sent an unused item to someone and can not do this without banggood help.

Well I think at this point you need to first see the condition of the item when you get it. If it is only faulty, then you really don't have any case at all. If you get something that is quite clearly not in new condition, clearly having been used, then you should have a case with eBay, so long as Banggood will provide you with a letter confirming a new item had been sent.

You will really need to see what the condion is before you decide what to do. Getting a full refund has to be an option, but then you will end up paying shipping to return it. That may not be worth it, it might work out better to get the new gimble and then re=sell it again, but then it will be second hand and not worth as much.

So you'll have to work out what the best option is to do.

If its not one thing its another... the other quad that is a problem for me is the bayangtoys x16. The buyer said he had bad shipping damage and I allowed a return (unfortunately because of a lack of return policy it comes to me at my expense). The thing looks nearly perfect I am charging the batteries now to test how it runs. The buyer was nice enough to leave me with a rattling screw inside the quad and another screw shows unusual wear. I am contacting ebay about abuse of their return system if this flys without a binding motor like he said. I assume the screw was meant to cause the motor to fail when I try to use it!!!

IOTW someone decided they didn't want the quad and abused the ebay return policy.

actually the more I consider what I am looking at here the more problems I see... For 1 he left a note saying he bought my cx-20 months ago with a puffed battery but I have never sold a cx-20. There are old and new versions of the bayangtoyts quad I wonder if he upgraded to the newer version and gave me his old one. It does look awful new but when I look close I see some marks.

the feeback left for me was "item was out of stock" but that doesn't make sense for what has happened I think he just like to try and complicate things by adding out of place stuff like this note and that comment. heard the door open just now its time to test this quad as I have some batteries...

This was also shipped to me in a box that claims to be the upgraded version with camera but he was sold the no camera version.

Lot of stuff there no adding up at all at this point, will be interesting to see how the testing goes.

sounds great I put the screw back where it belongs it flies and I already managed to crash it and put a little notch in the propeller (small not bad and it comes with 2 sets of props). About 1-1/2 months ago I did sell someone a cheerson cx33s. I really wonder if this is related because he said he and his friends would be gracious if I would give him free stuff like batteries and cases. I reported him to ebay and he went away but maybe he actually does have friends... I could just be paranoid but something is fishy.

What you should do is get a video of it working and post that to you tube, then contact ebay with the link to let them see. If it works, then his claim is blown out of the water. Make sure you clearly identify it as the one returned and I would also be tempted to send him a link to the vid as well :)

By the sounds of it, no doubt at all that something isn't adding up.

When I get a store setup I am staying away from these high priced and popular items at first. I hope I have not upset banggood!

I think the most importnat thing for you is to maybe focus on getting your returns/warranty policy sorted out. If you have that covered, then you will save a lot of drama no matter if you have cheaper or more expensive items listed.

taking it out has proven to be an expensive mistake... They are not that easy for me to fly and it now rests probably in pieces on top of a county extension building. I took it up high and then it just kept drifting until it was so far away I had to take it down. I tried the home button before the sudden drop but it kept on going...

someone may be able to get it down but I have to wait for a break in the football game possibly even until monday

The buyer of the upair provided tracking so as soon as it arrives ebay takes my money

This actually could end up in court or some other type of legal bs. I do not know how far I can let this go before I have to just give in and loose!

Is there some way banggood can be contacted by someone with an order number to verify shipment details and that the item sent was not used?

I asked in chat and they sent me this...

Could you please fill the form and email us from this link

Now the tracking number has been provided this battle is pretty much lost. The only thing you can do now is take a look at it when you get it and see what the condition is. If it looks used, then get that letter from Banggood to confirm they only sell new products and hit eBay back up with that and images of the drone.

Yor only legal recourse would be a civil case you would need to bring against the buyer and I seriously doubt if that would be worth it.

I dont know how to get a letter from banggood. I had/have a BBB complaint where someone replied saying they had no emails from me and that it is impossible that they shipped a used item. I do not see it as part of the banggood profile yet tho

Just contact Yumi, she shoud be able to arrange that for you. You may as well wait to see the condition of the drone, if it doesn't look to be used, then eBay aren't going to take any notice of any further corresspondence any way. If it does look used, then I would be following that up.

This bayangtoys x16 quad is showing me why I lost control. I'm not experienced with quads and 1 of the speed controllers is burnt out that could be why it started drifting and would not come back. I bought new plasitc and a new battery. I may be able to fix this speed controller by using a wire as a jumper where the traces burnt. I have a question for banggood and will ask yumi. Basically I wonder if this is a bait and switch I got stuck with... there are 2 versions of this quad the one being sold on banggood has 'altitude hold' in its title and the receiver board in this quad is the same as the the receiver board they sell on banggood.com but it does not have 'altitude hold'. I matched the product numbers on the circuit boards. The reeciever board in this quad is light green the motor controller boards are more bluish green thats another reason its suspect.
